Constitutional Code

Art. By a fiduciary power understand a power
having for the object of its creation or say and collation a benefit
to be designed to be reaped by some person or persons other
than him or them on whom it is conferred.

Art. In what case so ever a fiduciary power
has having been lawfully created and conferred, the benefit sought intended to be
produced would by reason of the extinction of relative disability of the
person or persons on whom it was originally conferred be
otherwise extinguished, the Judge will at the instance of any
person, take effect such imperative decree or decrees as
shall supply afford an appropriate supply to the deficiency
whatsoever it be which has place.

Art. A case in which such deficiency is liable to have
place is part of a Foundation

Art. A Foundation is either unilateral or
plurilateral.

An example of an unilateral foundation is where by
deed or will an individual conferrs on a person or persons
a certain mass of property to the intent that he or they
should make application of it to some for a length of time
definite or indefinite to the benefit of some person or persons
other than himself or themselves.

An example of a plurilateral foundation is that of
a company of persons formed by mutual association
with or without a mass of property called a trust at the disposal of the company,
for the effectuation of some object regarded as beneficial either to
themselves or others or to themselves and others if for the benefit of them
it is stiled a trust fund.
