Constitutional Code

Art. 11. To power in every case private fiduciary power
included belongs a certain subject matter, – Under the tutelary on, over, or in
relation to which it is exercised. Under the power
powers of the Judge are brought by the nature of things such
subject matters of three sorts, namely 1. Personal. 2. in relation to which private fiduciary
power is comes to be exercisable lawfully exercised. These are – 1. Persons
individually considered; 2. Things at large; 3. Foundations.

Art. 12. 1. Persons. Placed of necessity under fiduciary power are persons
at large divers events considered in relation to
this effect may be termed location events. These are 1. Infancy;
2. infirmity mental imbecillity

at large by mental imbecillity: considered relation had with reference to
this same power, it may be stiled its locative power.

Art. 13. Such imbecillity is produced by two causes – one certain and universal
– infancy; the other accidental andinsanity mental derangement.

In the case of infancy so long as either parent is alive
the fiduciary power in relation to the infant rests of course
with the parents one or both: on the death of both the
infant is stiled an orphan, his condition in that respect orphanage:
on the death of either, a same orphan his condition
some orphanage. Guardian in this case is the appropriate
appellation of the possessor of this power. The parents
are Guardians by nature habitual Guardians: any person invested with that
power by the act of man, is instituted Guardian by appointment.
If, , on the death of those his natural guardians during
his infancy, no person has been instituted Guardian by his those
natural Guardians in either of them, the fiduciary power and obligation power of locating a
person in the situation of Guardian with relation to him, devolves
upon the Judge.
