Constitutional Code.
Art. 29. III. Foundations. This is the sort of case in which such
deficiency is most liable to have place. The course of genealogical
succession is traceable with comparative facility:
and no b under no Government has it of his has passed altogether unprovided for,
and when all threads of genealogical connection are broken
there remain always the rules or rulers who are not bestowed
in the inclination to receive what is to be received.
Art. 30. But when for an indefinite length of time a proprietor or
set of proprietors are to be provided, here comes a demand
for foresight: and for such foresight as is not infrequently
at a fault.
Art. 31. Moreover, in this case, whatsoever be the adopted
course of succession designed, the effect given to it must depend
upon the will of the government: and the every such act
of foundation being an act of pars, having for its instrument
the matter of reward, rulers will not in general without scrutiny
suffer it to be exercised by hands other than such as
they approve of, nor to be applied to purposes other that what such
as they approve of.
