Art. Second deobligation or say invalidation
causes, accidents.
Examples as follow
In this case is by invalidation the case accident be such that in consequence of it no disappointment will be
produced on in the part breast of the promise-receiver, the invalidation
will be compleat and absolute.
If by the non-invalidation or say the enforcement
of the pact no disappointment will be produced on the
part of the promise, no invalidation will have place,
the enforcement of the ob pact will be compleat and
absolute, the accident notwithstanding.
If in an event there will compleat disappointment
will have place on the one part, in the other event, on the
other part the Judge will divide between them the evil of
disappointment, as circumstance may prescribe: and
in particular the pecuniary circumstances on each side.
