The a quantity of matter necessary to pare down confuse
the picture portrait within the limits of correctness would not by the
value of the information afforded by it pay for insertion.
The essential points are
1. That originally the a rule of action could not to an extent
approaching in any tolerable degree adequate be an adequate one to this purpose could not
be made by any authority other than that of the Judge.
Legislation in the sense in which given at present to that word is at
present understood, there was none. For
3. For the only authority constantly in action activity was the
King.
4. As for his immediate tenants – his great Landholders
they never came together except when summoned by their
universal landlord and when some when in pursuance of a summons from him after they had
once met of whether they should ever meet again
was matter of chance.
5. When the King issued an Ordinance it was like a
General Order issued by the Commander of an army say
by the Commander in chief. Centuries elapsed had followed
Century, before it was understood that an Ordinance
emanating from one King would be considered as being in
existence, and obedience to it accordingly called for and
enforced, by his next successor.(a)
(a) See Barrington's Observations on the Statutes.
6. The Judges accordingly, the Judges of the several great Superior Courts as to everything in the way of legislation that was
not done as above by the King and the very little that
from time to time was done by K at first by King and
Lords, and at length by King Lords and Commons, acted
in the place of a Legislature.
