☞ Should this be in text or Note? and, if in Note, where?
When Judges are stated as to functionaries by whom
the imaginary suit of law Common Law has been made
for shortness only is thus the expression made use of,
for in the production of the rule of action in this cloudy shape
other hands besides those of Judges must it is evident have
borne a part. In the production of a mass of really existing law three
sets of hands joint authors wills must in every instance have concurred, those of
the House of Commons, the House of Lords, and the Monarch.
In the production of a mass of the imaginary suit of imaginary
law contained in a printed Report Book three authorities contributors or
wills must in like manner have concurred: namely
the Judges, the Note-taker, and the publishing Book-seller.
Without the Judge there would not have been nothing anything to committ
to writing, without the Note-taker there would have that which
is written would not have been written, without the publishing
Bookseller it would not have been published, nor so much
much as printed.
