Add inefficacy of oath unattended by temporal punishment.

Mendacity-license has established. Necessity of Oaths, how
employed in the establishment of it.

Two things points on this occasion require to
be explained. 1. that by the practice of the Judge, and so thus
far, and in this sense by law, no to mendacity and
effectual licence has been and continues to be given:
2. Secondly, how and by what machinery the effect of
is produced. As to the profit to the profession and the loss
to the public at large, on these heads an explanation has
already been given, an explanation, it is hoped a not altogether
insufficient one to for the purpose.

1. As to the fact of the establishment of the alledged licence.
By Statute law, the granting of licences for the performance of so many sorts
of operations has been established on a variety of occasions.
One of them the licence to vend spiritous liquors: called a Spirit-licence.
On this occasion two things are intended, one is in
the first is – that certain conditions regarded by which in the eyes of the
legislator man in authority are desirable ones, should be fulfilled: the other
is that on by all such persons by whom the conditions are
not fulfilled, suffering to in a certain amount shape should be endured.

Take for instance, the case of a spirit licence. The object of it is –

the public revenue to

of money to be pai

government by every
person who occupies
himself in the vending
th spiritous liquors under
the circumstances therein
mentioned. For this purpose
By the
Statute by which it is established it is enacted in the first place – that whosoever
without having taken out the therein mentioned licence shall
in any instance have made sale of the sort of liquors in
question shall on that occasion be made to forfeit and pay
so much: in the next place that whosoever within the time prescribed shall have
taken out such licence shall be at liberty to make sale of such
liquors to whatsoever extent he is able deriving from such sale
whatsoever profit benefit in any shape may be derivable from it.
