Blackstone familiarized
Hence forward as often as whenever the word right, a right occurring
the species Considered as being of right meant to be presented to view, is the legal right, as above.
In so far as produced by law and so considered every benefit imaginable
benefit may be, and is, termed a right. The benefits
of which the law of a country gives possession, and in respect of which the law gives it gives and establishes security
are rights.† † Remember the 4 modifications of security
Correspondent to rights are obligations and services the thing – legal services.
That which rights are with respect to benefits, obligations
are with respect to burthens.
Rights can not A right can not have place but
with reference to a correspondent benefit.
A right may in every case be said to be a right to
a service.
A service may be is derived either from a person or
from a thing.
A service due from a person may be either due
either from the person simply or from the person with reference
to a thing.
The only possible possessor of a right is a person: to speak
of a thing as possessing a right is absurdity and nonsense.
In a large sense animals endowed with sensations are
termed things: and though so termed, in a moral sense
every such may be said to have a right to be well treated; in so far
as is consistent with the use which men have need to make of them
yet in a legal sense no such thing can be said to have a right:
at any rate a right
exercisable by himself:
though by any man
in quality of its
a right may be exercised
on behalf of the thing animal: as
is actually the case under the laws made for the repression of cruelty to animals.
