What is equally known is – that with exception to an
extent comparatively inconsiderable, in the hands of the Monarch
is his powers of displacing at pleasure, and without reason assigned
the occupant of the several Offices, last abovementioned: and proportioned
to this power is the of course the efficiency of his
influence.

What is moreover true is, that while in his in regard to punishment
that and thereby in regard to the effects efficiency of the Penal branch of
law the power of inflicting punishment subject to a certain extent
to the contract of the Jury is made over to him to those
of his nominee creatures as above to whom with the name of Judges
or what be equivalent to it the power of inflicting punishment is
committed by him, yet, on each individual occasion whatever
exercised is by any one of them is a given to the power of
inflicting punishment, it is in his power to frustrate, to veto
by the power of pardon: and that to this power exercise may
be given and is given, not only after sentence pronounced by
the Judge, but before prosecution commenced: a the consequence is insomuch that
it is in the power of this one man to whatsoever deprive any and
every other of whatsoever security he derives from the appr
institution
whatever remedy after a against crime or delinquency in any
shape is afforded by punishment.

Of this power of pardon one consequence is, that at
all times the life of every other member of the community
is at all times in the absolute power of the Monarch.
"Behold that man there, – go and put him to death – this done,
"such and such shall be your reward, and for so doing you run no risk of
"being punished, for here is your pardon which I will sign
"as soon as the deed is done". This is what every Monarch has
it in his power at all times at a to say to any man: and having so used, to
act accordingly.
