The Function of a Judge will as such. The diversification
which the aggregate body of those functions
admitt of, and require to be brought to view will be
determined by the different classes of other persons, on or in relation to whom
in quality of actors in the judicial theatre, the powers
appertaining to his office.

These may be thus enumerated –

1. Applicants: among whom are included pursuers,
pursuit being the principal and most commonly exemplified
purpose, out of several, for which application to a Judge may be, and requires
to be admitted to be made.

Another purpose is simply giving information, without
appearing in the character of pursuer.

En English practice this purpose is exemplified at
the instance of those applications which are made to a Justice
of the peace, antecedently to the time at which he is
bound over to prosecute.

The term pursuer is here employed for the
purpose of including the two sorts of applicants respectively
termed plaintiff and prosecutor in Law as it is.
The word plaintiff is the word employed when the
sort of suit is expressed by the name of a civil suit, the
word prosecutor, when it is of the class which is expressed
by the name of a penal or criminal suit: in which
case it is stiled in one word a prosecution.

In a suit termed a penal is certain sort of suits
which are half civil half penal the plaintiff or say
the prosecutor is stiled an Informer or Informant: and the
sort of suit an information. But in this case the meaning of the word
information is very different from that what it is as above,
for on the occasion of this
species of suit a man
can not be admitted
to give information – to
act as informer – without
acting as plaintiff or say
prosecutor at the same time.
