§. Publicity, recordation, publication – For the
production of these effects Law, as it ought to be,
provides arrangements by which they can not fail of
being in the most perfect degree accomplished.
Publicity has been ob As Ingredient in other proceedings of government in other
Departments, so in the department of judicature, publicity has
two uses, one regarding the present, the other regarding the
future. The present object is – the giving to all persons
motive interested concerned at the present in point of interest to
be informed of what is going forward that whatsoever information
is capable of being respectively of use to them: the
ulterior object is the gaining giving respecting those same matters
the like information as to all times to come.
Law as it ought to be has found actually in use,
though for different and inferior purposes, a mode of
writing by which to future times as well as to present all this information may be applied
comparatively speaking at next to no expence.(a)

On this occasion however, considering that as writing especially
so large an amount a quantity is the least least least quantity sufficient
amounts, writing is an operatic which can not be performed
without proportionable expense, one care is necessary; and that
is to push out and separate from that the quantity which will pay for the truth
that which will not. Least of all can Law as it ought to be
endure the causing to be written, heaped together and keeping kept in store whole masses
of matter for which this no use whatever can be assigned.
