1828 Aug. 25
Blackstone

No. Applied to Persons what that which the word
of indicates refers to and gives intimation of is the possession of the right: applied to things that
which it gives intimation of is the subject matter of that same
right: for so it turns out when as he comes to speak of
the various sorts of things+ B.O. Ch I Art. 1. page 30, and of the three sorts of things, which
for the purpose of understanding of what is done by law it is necessary to distinguish, and which
accordingly by the laws of all countries are actually distinguished
an account has been given above. So far so great.

Now for more confusion. In the same article
still speaking of rights, he expressly confounds them with
duties: the according to the sort of person with reference relation to whom
they are considered, the self same rights are both either rights
or duties: or say are both rights and duties, a right
"simply" (says he) when it is the person to whom they are due that is regarded:
"duties when it is the person from whom they
"are due".

Duties says Blackstone. Duties – the word employed
on this occasion: obligation for the is the word the
use of which has, for carrying the only which is
to the purpose: been and by us in preference as above. B Of itself In place
of or in conjunction with legal duty, moral is the sort
of obligation the conception of which is apt to be conveyed by the word duty,
and this conception belongs not to the present purpose.
Not but that the phrase moral obligation is in use:
but still, taken by itself duty is more apt to convey the
idea conception of moral obligation, than obligation taken by itself is.

Not improbably, with or without perceiving it, what on the
occasion of the employment thus given use thus made by him to the word duty, a
wish of his perceived or unperceived by him was to convey mention no
further the persuasion that whatever it is made a man's legal
obligation or say duty
to perform, it is thereby
also made the same man's
moral duty to perform.
But were suppose this admitted
admitted thereby would be,
though in other words that it was is under every government the duty of every subject to pay absolute obedience to whatsoever
mandate should emanate from the ruling one or ruling few, and this by absolute obedience on the one part create and confer absolute power on the other: – absolute power,
to whatever degree
abused, and in whatsoever
shapes the above exhibited itself.
