1828 Aug. 24
Blackstone

To proceed. In the his next Article – Article 5, persons
to inform us are either natural: or artificial. By
natural persons he means what everybody else means,
by artificial persons he means "bodies politic or (say)
Corporations. Persons and bodies public or say corporations
in words appellatives what every we all of us has
frequently, person continually scarce to use: artificial
persons are is an appellative what nobody has need to use: better
without than with them would the language be. Other
occasions there are besides the above there are in which the
need his plan of speaking of persons in the aggregate: but
on for those occasions, common language in union with as well as his language
has the word party: this we say, party to a
consequence, part to an engagement – party to a suit
at law: in which cases it is employed or at least may be indiscriminately
to designate signify a single person, or persons in any great
number, in in so far as the case where they are all of them, on one
and the same side.

As to the allowing lawyers to ply their practice with the
word person, there is no need of it, and there is no small
danger in it, say rather mischief from it: allow them to
speak of artificial persons, they will take in hand natural
persons, and speak of them as dead while at they
the same time on the same occasion they speak of them
as living: speaking of this or that person, they will tell
you he is dead of . Admitt that he is dead in
law, thereupon except as to the making him dead and in fact
by killing him, they will go to work and do with him
whatever suits their purpose they please: what else they will may do with
him, depends upon circumstances: but what they will be seen
to do with him – what in every case they will do with him, is –
to plunder him.
