11. Next comes Art. 11, wrapt in the clouds of
pretty much the same description as the last preceding one.
The right of personal Right expounded, the right of private
property: exposition given of it – the information
that it "consists in every man's free use and disposal
"of his own lawful acquisitions, without injury
"or illegal domination".

Note here the words every man's: inserted
here where the right of personal private property is the
subject matter of the exposition; – not inserted thus,
where it was the right of personal liberty that was
the subject matter of the exposition: what could have been the
is the rational cause ground of this difference – what could
have been the efficient or final cause of it let any one, that
has a mind to puzzle himself, set himself to imagine.

Then again the word private the specific and
limitation epithet private attached to the word appellation
property what has it to do here? whosoever it be that
the subject matter is supposed to belong to is not the
manner in which the right to the benefit of from it is
created and composed, exactly the same? the same
for example whether the proprietor be an individual, the
King in as trustee for the community at large in general or an servant in Agent of a
House Joint Stock Company as Trustee for the company?
In any one of the three cases, if Cupidus an
acquaintance Cupidus takes the horse openly under the apparent
notion that he has a right to it, that the horse
is his – will he not alike be subjected exposed to a what is called an action:
if he takes it without any such notion, on the contrary clandestinely and
under a consciousness of his not having any right to it,
will he not alike be subjected exposed to what is called an
indictment, and in
case of conviction, if so
it places the thing function of
mercy hanged for it?
