To us however the opposite order presents itself as the preferable
one – as the best suited to the purpose of explanation of
conveying clear conceptions. For so it is, that rights belonging to possessed by individuals
are capable of being understood, without any cognizance taken
of rights and powers belonging possessed by public functionaries considered as such,
for the understanding an adequate conception of the nature of right
belonging to individuals all that is necessary being – that there
are set of persons – to wit public functionaries, by whom the
obligations correspondent to and creators of those same rights have
been imposed, and will upon occasion, in so far as the profession
made on the occasion are fulfilled, be enforced. As
to who they are – those possessors of public rights and powers –
how they came by them, what are the exercises they are expected
to give to them, and by what events or states of things they may
be made to cease to possess them, these are topics matters which
to say the least will be much more easily and clearly understood
after an explanation has been given of those others have than before.

What is more, the rights powers and obligations
which belong to individuals in general as such – to individuals
whether they are or are not invested with public function in
any shape, all such individuals are at all times interested
in bearing of in in mind; whereas, in the case of all those
who neither actually do, nor ever will take any part in
the endeavour to apply, limitation, direction or addition to the
mass of those same public rights and powers, the
bearing in mind the arrangements by which the actual state
of those same public rights and powers are is constituted, will
at any rate comparatively, if not absolutely be of no use.
