☞ Sept. 29. This to begin with
instead of the matter dated Sept. 24.

The use and purpose of the law(a) is to confer benefits(b),
to confer them principally on those who are subject to
it(b)(c). But man is (as we shall see) such is the nature of man
and things, no benefit can be conferred on any
person by law without the imposition of correspondent
burthens. Accordingly, throughout the whole of
its course, the object of the law, in proportion as it
answers its professed and only proper and defensible
purpose, is will be – to maximize( ) the amount of benefits
– to minimise( ) the amount of burthens. In the
degree in which the amount of those same benefits exceeds
the amount of those same burthens – in this degree
does the law at all times answer fulfill or say
answer this its purpose.

By benefit on this occasion, we mean, if we mean anything,
good considered as produced by a certain efficient
cause: or say, as flowing from a certain source.

By good, if we mean anything we mean pleasure
– in whatever shape or exemption from pain
in whatever shape, or an efficient cause of such pleasure
or such exemption.

By burthen on this occasion we mean if we mean anything,
evil considered as produced by a certain efficient
cause: or say as flowing from a certain source.

By evil, if we mean anything we mean pain
in whatever shape or exemption exclusion from pleasure in any
shape: or an efficient cause of such pain or such
exclusion.

A good may be considered with, without reference to the
effects of the act whereby it is produced, or with reference to those effects. If Considered without reference
to its those effects, the slightest pleasure imaginable may be termed a good
although by the acts by which it is reaped pain to the greatest amount imaginable
be produced. Not so, if considered with reference to those
effects. And so in the
case of evil.
