With this exception, the indication of which is made
for no other purpose than that of excluding incorrectness in the
one party and misconception in the other, only by the by the force of the
conferring
establishment of a corresponding right can a benefit be
conferred.

Now then in what way is it that by the law
a right is created and conferred? by what means? by
what course of action? – let us see

Only by means of a correspondent obligation or
correspondent obligations can any right be created and conferred,
no obligation, no right: an obligation is to a
burthen, what a benefit is to a right.

No obligation we shall see find can be created have place, but by
means of a correspondent command for a certain quarter
or sources nor can any command have place to anything
approaching to an the adequate and requisite effect, but
by means of punishment: nor consequently can a right be
created and conferred, otherwise than but by means of command or in
punishment. But of this further on.
