☞ Efficient causes of commencement and cessation
Obligation will have as well as right & benefit
So, Rational causes.
Benefits have their sources: real sources, and imaginary
sources, as above. For obligations, no such sources are to be
found.
Corr That which possession is to be if it in the case of benefit, subjection
to it is in the case of a burthen an obligation in the
case of a burthen.
Correspondent to sources of benefit – all of them so
many subject matter of beneficial operation operation beneficial to the
possessor – are in the case of a benefit are sources of
and subject matters of burthensome operation in the case
of an obligation – in the case of a burthen.
☞ Apply this to the obligation part of trusts.
The benefit, in various three shapes, derivable from the
the transmission of a subject matter of operation which is a
source of benefit has, as above, been mentioned mentioned brought to view.
In those several shapes may a burthen or the result
of the transmission of an obligation from an individual
or other party to another.
Of a benefit the value is limitable in each one
of the three ways above mentioned. In the first of those three
ways so may the burthen burthensomeness of an obligation: to wit by
means of co-obligees by whom the burthen is shared with
the obligee first mentioned.
So likewise by limitation put to the amplitude of
the mode of operation to which the obligation applies,
and this whether the operation or say agency be positive
or negative.
As to the effect of a limitation, applying to the part of
the subject matter operated upon, this will depend upon the nature
of the subject matter, and of the operation to be performed upon it.
