1828 Sept. 27
Blackstone or Civil Code

Subject matters corporeal – movable and immoveable
distinction between immoveables and moveables.
Doctrina or Astrea

When and as son as compleat situation of continuity
has place between itself and the other parts, every part of the immoveable portion of the
earths surface possessed by man became thereby aggregated to the
class of moveables.

Solution of continuity between the onea moveable mass
and the immoveable basis has place when by between the
one and the other on every part of the surface of the
other an interval has place which is occupied either
by air or water, has place.

Felicia. Thank you Madam for your explanation:
but excuse me if I say, that the distinction makes no difference.
If, from a piece of land or a building of mine anything
that has a ruler, be it a form of star, or piece of metallic
ore, a truffle, an oyster or a plant, or the root of a
plant for example be illegally stolen from me or
otherwise illegally taken away from me, what matters it
whether in relation to it at the time in question solution of continuity had or had not place.

Doctrina .. What say you to this, Gubby?
Guberman. I say it matters a great deal. But as to
solution of continuity, that is no better than surgeons language.
The difference I look to is that between savouring
and not savouring of the really. When you say Be the thing in question what it may
solution of continuity between that and what is immoveable
has not place, I say the thing savours of the really: and
whatever savours of the really, I allow any thief to shut
without he being punished as such, and the question whether
the savour is strong enough, is one of those out of which
business is made: business for learned Judges, and learned Gentlemen
of all sorts and sizes: business for House of Commons and House of
Lords Clerks. Two not to mention minerals already there are pages some size – 60,000 different
sorts of vegetables: and
with great management
extracting from them respectively
the sources of
the really might find matter for as many Acts of Parliament. Apply to my Professor Blackstone. has this savour is to his learned senses.
