Deposit by way of
pledge what
If, in addition to the benefit service rendered by the Depositee
by becoming responsible for the safe custody of the property
in question, is added payment of a certain sum of money
to the depositor, on condition that in case of nonrepayment
within a certain specified time, the property deposited
or some part of it, shall be transferred to the depositee in lieu
of such sum of money, then the transaction is termed Pledging.
In these cases where interest is to be paid by the Pledgor, the
and in failure of paying such interest within the specified
time, the pledge becomes forfeited, — it is called Pawnbroking.
By varying the rate of interest to be paid at stated periods if
the pledge remains unredeemed, the system of Pledging may be
rendered in any degree complex.

Obligation by Pledgee
to Pledgor
The Pledgee is under an obligation to produce the pledge
if the pledgor wishes to redeem it by paying the a sum of money
equivalent to that paid to him by the pledgee, within
the limited time, but the Pledgor is under an obligation, either
to pay the interest or repay the principal. The benefit derived from
the transaction by the pledgee consists, in the chance he has
of becoming possessed of the pledge, which he considers of more
value than the sum of money he gave to the pledgor. The benefit
derived by the pledgor, consists in obtaining what he considers
at the time of the transaction + + (taking into account
the probability, of having
repossessed of it) an adequate portion of [metals]
of universal exchangeable values, for a portion of that species property which
is only partially so.
