Blackstone. Madam, (speaking with respect) all these are trifling
things. We have a Latin maxim that provides for them in five
words. In English, The Law wastes not its case upon trifles. In
Latin. De minimis non curat lex. This word minimis
is the more significant and convenient, convenient as it includes
persons as well as things. Equity is law in its mode perfect
state. By Equity practice an interpretation construction has been put upon
and application made of this same word minimis. Penall
the case of a Court of Equity has been declared to be
every sum under £10. To be sure, millions there are of his
Majesty's subjects in whose instance income and expenditure
do not rise so high as to this amount: and when in a Court
of the superior sort a proceeding is instituted than this
amount must be advanced before any answer can be so made
or called for: and as all sums below £10 declaredly no better than
than trifling sums — not having
no claim to attention on
the point of the law, nor
accordingly receiving any
