Remuneration employed in the purchus of the whole
of the functionary's time
Remuneration may be attached to the service
without regard to time except thereon employed
or with regard to time so employed
When attached to portions of service without
regard to time thereon employed, the pay he applies payment made
is stiled payment by the job. Examples are
in Judicial service, fee attached to, given in remuneration
for judicial operations, themselves, and
the permanent results of those same transitory operations; of
which the principal examples are written instruments
When payment is attached to time, the time
it is attached to is either the whole length of the functionarys
employment how without solution of continuity other
than those appointed for necessary relaxation necessary
or customary or with solution of continuity; being in
this case composed of portions of time separated
from each other by more or less distant intervals.
Payment for the portion whole of the functionarys applicable
time is stiled payment by salary: payment for
separate portions is another mode of payment by fee.
