Blackstone or Civil Code
Promissory Note and Draught Bills of Exchange – Nature of each
relation between the two.
Understand by A promissory note is an expression of will uttered
in writing by which a promise is made to render to some
person therein named the service consisting in the transmission
of money, to an amount therein named.
The person mentioned as being he to whom the service is to be rendered may
be either a person therein named and he alone or that
person and any other person to whom he shall have transmitted
the right to receive it – and so on through a chain
of transmitters or say conveyers of in any number:
in this case the chain whatsoever be the length of
it is designated, and sufficiently and effectively designated
by the words – the bearer.
In the case Attached to this promise is commonly
another having for its subject matter the additional service
rendered by the conveyance of money to the amount of interest
at such or such a rate, the amount being proportioned to the
length of the interval of time between the day on which the
instrument is stated as having been signed by the
maker of the promise in like of its having been made by him
and the day mentioned as the day on which the original
principal service is to be performed rendered, the principal
promise performed.
Such in practice is most commonly the nature of the
transaction but the promise by which the obligation of rendering
the service least valuable of the two services is created – is
an unessential adjunct which may have place or not, without
making any difference as to the species of promise.
☞ Here go on to shew how by writing his name on the Note and delivers
the note it to any other person at pleasure the person to whom the money
is rendered payable promises eventually to render to him the service on consisting is⊞ ⊞ rendered by the convenance
of a sum of money to that
same amount: and so on
through a chain of endorsers
in any number. Shew also how the effect producible by the words or bearer receives limitation from the substitution of the word Order.
