If transference for limited
time — you are in certain
sense still in possession
If so it be that the transference is only for no more
than a limited term, at the end of which the right to the
thing reverts back to you or yours, you are still in
a certain sense, common parlance said on some occasion to be in possession of it.
You have let to a tenant
per lawyer you are in
possession, unless you have
agreed not to pay (Quere) receive)
rent
Thus if you let your house to a tenant, a Law
a lawyer will on certain occasion say tell you that
you are in possession of it: at any rate unless it be an
ascertained fact that your resolution has taken and abide
by a resolution not to pay the rent agreed on: in which
case he is said to have put you out of possession of this
same house of yours.
Here you are in possession
or not, according as on endeavouring
to apply manual
control to it, other
persons oppose against
manual obstruction.
Thus it is that as to other persons in any number
you may be in possession or not in possession of your house
or any thing in it or out of it according as upon and in the event of your
endeavouring to apply manual control to it their determination
is or is not respectively, to oppose by their own or other hands ob manual
obstruction to your so dealing by it.
