(1 Efficient course of
commencement and cessation
of rights, all matter reducible
under this head

☞ By anticipations, the case is supposed to be as follows: whether
it is or no will all along in the course of the work, be a
subject matter for consideration.

A Benefit — may be enjoyed
without — or only with thro' intervention
of Judge — if an
efficient cause of right has
occurred in my favor — & non
of cessation of right. Every
thing in Civil Code except procedure,
under one or other of
those heads.

This benefit — be it what it may — is it or is it not in my
power to enjoy it? This in the first place which is the best case for me) without need of
recurrence to the Judge: in the next place, with by though not
without otherwise than by recurrence to the Judge. Now then w Whatsoever be
the benefit, and whatsoever the time in question, in one or
other of these cases with relation to the subject matter in question
I can not but be With this To have it in my power
to enjoy it is in other words to have a right to enjoy
it with or with the intervention of the Judge as above
Have I then a right to it? Aye, if with relation to it
any one of a list of efficient causes of right [or of
title for on this occasion this word also is employed] has taken place in
my favour, and with relation to this same right no efficien one of a correspondent list of efficient
causes of cessation of that right has taken place. Thus
then under one or other of these heads so far as regards benefits and the correspondent right may be ranked
every matter that can have place in the Civil Court of the
all comprehensive Code, the system of procedure excepted.

Susceptible of numerous
diversifications; ingredients
of which a cause may be
composed numerous also
as an Election.

True it is Multitudinous Numerous it is true are the diversifications
of which the subject matter of right is susceptible. Numerous
in like manner are the elementary ingredients of which an the
efficient cause of commencement of any such right
is composed: as for instance in the case where it has for
its efficient cause an Election: an operation in which persons
in any numbers may be jointly occupied: so in like manner ) 2y.

but still of the aggregate of all these elements one single efficient
cause is in both cases composed constituted
