Blackstone or Civil Code

like brackets in a will

(3 Efficient causes of commencement
and cessation of
the all matter reducible
to these heads

So a Bill of Exchange passing
from hand to hand

All that is material to
know is state of the
causes of commencement &
cessation of right, at the
charge of the persons in
question, procedure before
Judge supposed to be the
same in all cases.

So in the case of a Bill of exchange passing from hand
to hand through a succession of endeavours: in relation to the sum of money in question, and
the sort of service by which
it is transmitted
efficient causes of
commencement of [the] right and efficient causes of coflation of
that same right may along with the designation of the printer
respectively to engaged for self bread for the rendering of that same
service succeed to one another like [wildfire:] || ☞ Here introduce
some appropriate
mechanical image.
But
still all that for a practical purpose, for the giving direction
to human conduct all that is material to know
is the state the case is in as to efficient cause of commencement
and cessation — of existence and extinction of
the right in question at the charge of the several persons
respectively in question the mode of procedure before the
Judge in case of obstruction given to the engagement of the trustee
from that same right being also supposed to be the same in all
those several cases.

All this may be said
of burthens; they inseparably
attached to benefits
& rights — tho' burthens
may exist without producing
benefit to any one.

To benefit burthens and obligations what has been said in relation
to benefits and rights may be said at the same time,
for so it is the rather because these two objects are inseparably attached
to one another; that at any rate in such sort that is to say that no benefit can have
place without a correspondent burthen or set of burthens:
though it is but too true that burthens may have place
and but too frequently are made to have place without and be
imposed on persons to in unlimited number without
the production of benefit in any shape to any one.

In this case substitute
obligation to right.

But in this case, to the word right the word obligation
must be substituted: efficient cause of the commencement
or say birth of the obligation — efficient cause of the cessation or
say extinction of that same obligation.
