(4) (2) Void — nullity &c
Instance of nullification of a damage-giving
verdict for defamation — omission of the words "of
"and concerning". See Morn. Chron. 16th July 1828. King's
Bench Fisher v Clement. — Refer to the case of Sheen
who cut his child's head off, but was acquitted because
the child's name was mis-spt spelt in the indictment.
Void, null and void — not good, bad, quest, vacate,
set aside for irregularity, all these expressions have one
and the same value for their ground: [for the use made of them
the same cause:- a cause here too often brought to view to
need repeating.] of This mode of defeating justice, and disfulfilling
the virtual promises made in this respect on this occasion by government, has for
its cause to a considerable extent, written pleadings, and throughout
its whole extent the suffering the rule of notice to wear the ideal
form of common kind instead of giving to it the real form of statute
law.
