☞ Add remedy had denied as to restitution?
Expence under this head by Law as it is and as it ought
not to be, and as pretend not to be being the unavoidable expence
being left unproved for. Law as it ought to be
cash lays ultimately, and for as far as money each upon
the party in the wrong, but in the meantime, provides for
it at the charge of the lot public by an appropriate fund
stiled the Helpless litigants fund: adequate proof of the need of it
having been received, and for the purpose of distant profit
obviated. As to this see below, §.
7. 3. Expence of professional assistance in cases
where by in which, it being needed really needful the means of defraying it are wanting.
For this part of the expence, Law, as it ought to be, provides
under with the title of Eleemosynary Advocate matching
with its Government Advocate who is to under Law as it
ought to be what the Duumvirate composed of Mr Attorney
General and Mr Sollicitor General is – to under Law as it is,
one for every Judge-shire, as to which sort, see below (§.)
each with as in the one Advocate as well as the other
with as many Deputes so it be at his own expence
as the quantity of business shall have shown him to stand in need of:
item, attached to each Judicatory, a set of Probationary Lawyers, serving the latter part of their
few years Clerkship, by rendering gratuitous service to the
otherwise Helpless Litigants on both sides of the suit: and thus
introducing themselves to profit-yielding business, as Physicians and
Surgeons do by gratuitous service performed in Hospitals.
