Judge's functions determined
by different classes
of persons over whom as actors
in jud. theatre he exercises
his powers.
These are 1. Applicants,
including Pursuers.
Informants, as information
may be given without ulterior
prosecution.
Pursuer includes plaintiff
and prosecutor, plaintiff
in civil suit; prosecutor in
penal do.
In suits called Informations,
plaintiff called Informer:
but none admitted as Informers
without being prosecutors.
In a prosecution two individuals
named – prosecutor
and the King, who tho'
styled plaintiff, does nothing.
Where he does take part
is when Treasury Lord orders
Attorney Genl. to prosecute
– these orders necessary
as fees are paid as in
all cases.
When King is pursuer &
when not confounded by
word plaintiff as applied to
him.

In cases where an individual
is pursuer, King
thro' Attorney General
may stop prosecution.
This fiction, besides being
useless and mischievous –
incongruous, by clashing
with fiction of King being
Judge in K.B. – If true
a mocking of justice.
Nolle prosequi what –
with this and pardon –
impunity may be given to
all offences.
Nolle prosequi more effectual
than pardon, which
costs 40s is more pe notorious
as it must pe be
under the great Seal.
