One disadvantage in this
to Judge & Co.—viz. by stopping
the fees. Purge swallowed
suit is at an end—no arguments
—judge not able
to set at naught verdict of
Jury.
In time this process found
not so productive as others.
Non lawyers wd have had it
the same as in any other action.
Here no lie & no justice
without—(as no dancing without
&c.) So Plaintiff
must say that Defendant
found it, altho' proved that
it was delivered to him.
Suppose those times you
bring your action. Cupidus
hires 12 men: he & they kiss
a book & mutter something.
Jury must believe what an
equal number have muttered.
Cupidus has the horse without
paying for it.
If perjury prosecutable
at Common Law then, not
worth enquiring. If yes, Cupidus
would keep the horse
and you if successful wd
have the satisfaction of knowing
that thro' the powers of
Judge over God—that Cupidus
would be in torments to eternity.
