11. Elementary functions being such with reference to the above-mentioned
executive functions.

10. Functionary exercisable in common by all Judges every Judge.
☞ Here enumerate them from J.B. then say
those of this enumeration are – 1. affording the clearer view insight of
the business of a Judge: 2. showing what may be the proper
business of a Jury, if as has been proposed, on the supposition
of the proper and practicable though as yet unexampled facilities, being given to Appeal
the last mentioned function to wit the imperative may for encrease of effectual responsibility
be given allotted to the Judge alone, all the others being exercisable
in common by the Judge and Jury.
