II. Prehensors
Prehendable: Defendant, yes
Witnesses not
For this service military
men preferable.
For this service as for every other, the more disciplined a man
is, the more fit. On this occasion by Law as it is Military
men are rendered employable, by Law as it ought to be, regarded
as preferable. The fewer there are of them, and the more
fully employed they are, as to all employment for which they are
fit, the better. Such is the rule are the rules/ masters of Law as it ought to be.
In all cases every thing to
be defined, that is susceptible
of it — In Law as it is, nothing
defined.
Exceptions excepted, and they are few and tolerably obvious
for the purpose of procuring on all occasions the appropriate and
requisite obedience puts all persons under the command of the
Judge: not on this or that occasion, but on all occasions.
Taking charge not to leave undefined any thing that being susceptible
had has need of definition. Law as it ought to be
be takes care defines these exceptions: to define nothing, to leave everything
undefined, to keep everything [that needs it,] from being defined – this as
among the cases of Law as it is.
Forthcomingness needful
for the more defendants the burthen
Pursuer pays Judge & Co for
every one.
Not less needful to justice, as above, being forthcomingness of
persons and things for the purpose of evidence, their forthcomingness for the purpose
of eventual execution, Law as it ought to be makes no more
simple of procuring it in the one case for the one purpose, than for the other,
On this occasion Law as it is is more scrupulous.]. It makes no such distinction.
Law as it is makes has its distinctions. Call a man a wit
prisoner, abscondant it cares little what is done with him.
Call the pursuer defendant a prisoner, it cares still less,
some would say not at all what is done with him.
The more there are who are are prehended in the character of defendants
are prehended, the better: because for every one so
prehended the Pursuer makes pays/has made payment to Judge and Co
and as to this matter whether any ground for the demand has place or is so much as believed to have place whether the pursuer has any ground
for his demand, or so much as believes himself to have]
[any] makes no difference: a fixt price is settled, at a price is fixt at which any person whatever may put
into confinement almost
any other man: and
which which, the power of causing a man to be prehended and put in confinement — in a word
which the personal liberty of almost every man is sold by the
Judge to every any other man that will purchase it.
