This may seem be thought a digression: but digression is not, what
it is necessary to, is the conveying and obtaining and conveying an explanation of the historical and efficient
cause of the difference that has in this particular respect has place
between the treatment given to a defendant, prisoners or non
prisoner on the one hand, and an expectant witness or other
evidence holder on the other.

Those Defendants should be so thus dealt with was necessary,
otherwise, of the money that actually or could be got either out
of them or as above out of Pursuers.

That persons at large, addressed in the character
and by the name of Witnesses should be thus dealt with,
was, reference had to this same universal purpose not
necessary. Under the name of a sub poena two Latin words meaning in English
under a penalty, instruments of accersition might in
any number be taken out directed to each one of a number
of persons altogether unlimited: whether they know anything
about the matter or nothing at all, not making to this purpose
any sort of difference. For sub poena with its
et cæteras, fees to one part section of the learned partnership – the official;
fees for hunting all the country over, for the purpose or
pretence of serving the sub poenas as the phrase is – that
is to say delivering it into the hand or other in some other
way making application of it to the mind of the proposed
witness, fees by without that to the other division of the
learned partnership – the professional.
