Blackstone
With or without ground for it, an instrument of this
sort might be addressed to, and accersition thereby made accordingly
(the King alone excepted) to whatsoever in the
country is most great most noble and most holy. Neither have Prime Ministers
Dukes and or Archbishops disdained thus to appear in ceremony
and pay homage to the laws: their second system of law which
has for such its object or end in view the greatest happiness of the
greatest, the most noble and most holy of the human race
to appear accordingly, when so it happened that appearance
suited their convenience: to receive the instrument, and deal
by it as if it had never been received, as often as that which
is undoubtedly the shortest course happened to be the most agreable.
Appear or pay a hundred pounds says the instrument.
But any such great or noble, or holy person, or any other
person when it were more agreable for the learned gentlemen
to oblige than to annoy, is it to be supposed that
he would ever be put to any such trouble as that of paying
a hundred pounds? Never since the commencement of the
law of money, as learned Gentlemen phrase, it has is any
precedent of any such ill breeding to be found.
Another thing is – that even where a desire and endeavour
to inflict punishment for non-attendance this same
threatened £100 is scarce seldom ever, if ever called for: but another
punishment of which no notice is ever given, that is to
say imprisonment or perhaps to an unlimited amount
has place. Well indeed might some more elastic
punishment be substituted, but for such substitution society
could not be kept together, for as often as the demand was
such that by compliance with it a man would suffer more than by payment of
the £100, a proposed witness whose leaning were on the Defendants
side if the defendant would receive from the Defendant the £100
and by non-appearance save him from everything
£100 millions were the amount of it.
