Blackstone

Ch. Judiciary [& Procedure]?
(16) (7) (6) Actors & Functionaries
III. Mandate Bearers

Attorneys accersiters enormous the expence
Proper Accersiters. Post Office

III. Accersiters. Learned Gentlemen know what Accersiters
are. Big of them to tolerate Accersiters. Accersiters religious as
Curators. In this it must be confessed consist the sole resemblance.
Accersiters are of indispensable use: indispensably useful: Curators, compleatly useless:
one and all — Curators
Bown at the head of them.
The best Curator was the
honest lawyer: the present
Curator is a Banker.

IV. Mandate Bearer, as
well as Standard do.

III. Mandate-bearers. Yes: (says Law as she ought to
be) why not Mandate Bearers as well as Standard Bearers
Pall-bearers, and Torch-bearers. Justice and her instruments
are at any the least of not less importance to mankind society, than
Palls and Torches.

Mandate Bearer — desirable
substitute to Prehensor.

Mandate Bearers are always desirable substitution
to Prehensor: or say conversely such as Prehensors are always undesirable but
too often indispensable substitutes to Judicial Mandate-bearers.

These functionaries ofsentially
different: to Prehensor,
military characteristics
indispensable, to
Mandate bearer only punctuality
& fidelity.

Essentially different howsoever closely allied are these
two species of Judicial functionaries. To Prehensors bodily strength
intrepidity, as well as fidelity, punctuality, [discernment and with the addition of galliness of deportment] in a word the military character in its most
characteristic features are indispensable: to Mandate-bearers
fidelity, punctuality, with a very to moderate and limited share of intellectuality, are almost of themselves sufficient
to the exercise of the function, even Quadrupeds and Birds — Dogs and pigeons have on some
and not without sufficient effect, on some occasions been thus
employed.

Letter post functionaries,
subservient to Procedures,
instruments, as with
Newspapers.

Leaving these extraordinary instruments for extraordinary use, Law as
she ought to be, lays her firm hands with no small satisfaction
on Letter-Post functionaries. Yes: why not Procedure instruments
of all this and all other sorts, as well as Newspapers. In the case of these instruments of intelligence By so simple an
expedient as that of leaving the folded paper open at each end:
why not in the case of those instruments of justice. Newspaper
backs reimbursement for the expences of justice, are charged with a
tax. Of that tax this is not a time it is not for Law as she ought to be to speak. Thus much only be
must shall have been said. Society can be kept together without newspapers: Society can
can not be kept together
without justice. Demand of Deny to a
man who has not a penny
the benefit of concresence
for a paper which is necessary to the establishment of any just demand
of his, so sure as you do this, you deny him justice.
