No wonder that what is called Common Law
being thus composed – composed out of general rules – general inferences drawn,
by any writer that pleases as many writers as please from particular decisions pronounced
or operation performed by Judges or sets of Judges in so many
individual occasions, the Common Law in contradistinction to Statute
law should be the object of such fond attachment and continued
praise: and the repugnance to the idea of covering the field of
action in its whole extent with Statute law to the exclusion of
Com this same Common Law the object of so much inward terror
and declared abhorrence.
One consequence is this stated in the impressive language
of the illustrious Irish Barrister Mr Daniel O'Connell† †Morn. Herald 15 July 1823 "We
"thus have, by means of an Index, to go through 5000
"5,555 cases before we can find something there, something
"which is something like the present case before us."
