In this case the object is to determine and
state in writing the power or purport of a will which so far
from being expressed, has not ever been so much as conceived and formed –
and when to this is added the liberty – the licence of
making and expressing in relation to the point of law averment in any
degree dis contrary to and destitute of truth, it may be
from this state of things it may be seen without much
difficulty in what degree such written pleadings are conducive
on the one part to the attainment of the ends of justice, on the
other part to the attainment of the actual ends of judicature as
here brought to view.
