Actes notariés date from the day when they are passed
they are evidence in a court of justice and are valid
till forgery is proved.
Its out force execution lorsque l'exedition est
mise en forme de grosse, i.e. they can be carried into
execution after a simple commandement by the creditor on his debtor goods can
be seized & sold if
the debt is certain
if uncertain they
can be seized but
not sold till the
debt ascertained.
Private acts as against third persons date either from
the day of their enregistrement or 2 from that of
the death of one of the parties or 3 from that of
their being established by official acts and as procès-verbaux
de scellé on d'inventoire or by a court
of justice – or against the parties themselves
they take their date from the day on which
they are passed.
They must be proved before they can be in order to be made available
admitted as party may deny his signature.
They cannot be carried into execution without
judgement.
