To the matter of the Civil Code and the
matter of the Penal Code and the Judiciary, or say Procedure Code as distinguished from
each other belongs this characteristic difference.
In the Civil Code no express mention is necessary
to be made either of any particular punishment or
of the Judge In the Penal Code references cannot
but be made explicitly or implicitly to the correspondent
matter of the Civil Code but mention reference
more or less explicit must be made to the Judge
and his functions for in so far as punishment
or remedy in any other shape is ordained or
ordinance distinguishable from any contained in the
Civil Code is issued directed to the Judge. In case of
contravention to an arrangement made by the
Civil Code punishment being appointed and the
Judge being the functionary under whose direction
application of such punishment is to be made a
separate and distinguishable ordinance in thereby made
directed to the Judge a surface service of a certain kind is directed
to be performed a service the performance of
which consists in the application of the correspondent and
appropriate remedy or remedies and the Judge is a sort of
functionary by whom or
under whose direction the
application of the remedy
or remedies is directed to
be performed.
