Constitut. Code
This equality is the obvious and solely only obvious proportion
as between share and share: and if for therefore any other
proportion any nam there be by that act the adoption of this part of
each mans affairs be liberty to be conducted is a maxim
more conductive contributory to the happiness of all, it lies with him
to point out such preferable proportion and to produce the
reason why it is so.
Every man should have the appointment of his own
Agent. Every man should have the appointment of his own
trustee – every man should have the appointment of his own
Executor testamentary. To these positions, every man, upon the very
first mention of them, finds feels his consent given as a matter
of course: no man, let him consider the matter ever so closely
or so frequently finds any reason for withdrawing it.
No man should have the appointment of any Agent
of his. No man should have the appointment of any Steward
of his – no man should have the appointment of any Testamentary
Executor of his. To From these positions every man, upon
the very first mention of them feels his consent withheld – as
a matter of course: no man, let him consider the matter every
ever so closely or so frequently finds any reason for bestowing
it. Palpable Absurdity is the quality which these several positions
present to his view.
In the instance of each man on every occasion which
there is for the appointment of an Agent to act for him, the
appointment should be not in him but in another man: and
so in the case of a Steward, so a Trustee, a Testamentary Executor.
Here would be another lesson of readily acknowledged
absurdities. And by each such position would of course be
suggested the question – and who is that other man that other man who is he? and to
this question no answer would ever be to be found by anybody.
