1823. May 3
Constitut. Code

If for the conduct of such part of each mans affairs
as he is physically incapable of conducting in his own person
a man in the choice of whom for this purpose he never had a
part was on every occasion employed appointed, the emergence is
that on every occasion the Agent happiness sought to
be promoted in the conduct of the affairs in question would be
the Agent's own, not that of the individual whose affairs those
are were. By The principal in question in the conduct of such of his
affairs as he conducts in his own person, the individual whose
happiness is exclusively or preferably endowed to be promoted
as his own: in the case of those others of his affairs who the conduct
of which is in the hands of a person in the claim of
whom he had no share how can it be otherwise.

True it is that in the case of an individual Agent
chosen by another his principal for the conduct of a certain
portion of the principal's affairs, the individual whose happiness
is in the management as far as depends upon the apt management of their exclusively preferably
consulted is the principal and not the Agent himself. But
how happens the to what causes is this proof due execution of the
trust to be attributed? To one or other of those causes. Only
to the state of the laws as to that of the form of public opinion, the trustee
would find his own happiness diminished by the diminution of
the happiness of his principal in respect of in so far as depended the conduct of the
affairs in question: or else by a some particular connection which
his trustee has with the principal principal in by the way
by either of self-regarding interest, or by the tie of sympathy.

But in the case here in question by the supposition, by no such ties is the trustee
bound to the principal.
