§. 1. [Constitutive in the people, why]

For guiding his desire in the case of a representative in the
legislature he will have a much more ample is the stock of
data material he will have will every man have than any man
has for to guide him in his desire of a medical adviser or a
legal adviser. In the cases Of the art and science of government the first lines
are perhaps not less difficult to discover draw aright than in that of medicine. But
supposing them once drawn and drawn aright they are much
less difficult to be understood than in the case of medicine. To In
medicine technical terms – terms that have no place in ordinary familiarized
conversation, abound to infinite: in government, there are scarce few indeed are
the technical terms: and by apt exposition those few may
without difficulty be rendered readily and universally intelligible.

In the next Chapter of this book the qualifications desirable functions belonging to the
situation of legislator, and at the same the qualifications necessary to the apt discharge of those functions
on the part of a legislator, the qualifications by the possession of
which a good legislator is constituted an apt working member of the legislature is constituted are endeavoured to be
laid down, namely in the Legislators Inaugural Declaration:
in that instrument scarcely a word can a word be found which belongs not to ordinary
discourse to be found. With this document in his hand, upon
every candidate for the situation will the eyes of every Elector
be of course fixt. With such documents before him all objections
grounded on the unfurnished vacant audition of man made in countries where
no such thing as a Constitutional Code is in existence vanish.

To the case of an as yet untried – untried that
is to say in the particular situation here in question applies
the main not to say the only difficulty: by the supposition all
data in all for judgment directly applicable to the present
case are here wanting. What he will have to look out for will
be general good character – or behaviour in situations most nearly
analogous to that in question.
