§. [Universal dislocation – why]

But the case are in question which is here principally in question
is the case in which the conduct to which it has application
is that of upon a public functionary who by the contemplation
of some good to himself or some other party in causes with
whom he stands connected by any of self-regarding
interest or sympathy, has been led to violate his corresponding public trust.

According By various circumstances belonging to it it is made
to appear and operate in various shapes modes and may accordingly distinguished
and divided into so many shapes, each of them designated
by its specific name.

1. It may be said to be primarily remunerative: as where
it is by means of the matter of good in any shape – the instruments
of felicity in any of their shapes – money, power, or any other
that the sinister effect is produced functionary is made to betray violate his trust.

2. It may be said to be secondarily remunerative: remuneration
effected by the exclusion of antecedently expected punishment:
as where the effect is produced in the mind of the functionary
by a pardon generated or looked for expected to be eventually granted to an
individual friend in whose felicity he takes an interest.

3. It may in like manner if any be said to be primarily
punitive, as where it is by the fear of punishment evil at the hands
of some this or that other person, having or not having political power that
the sinister effect in question is produced.

4. It may be said to be secondarily punitive: as where
it is by the fear of being dislocated out of a this or that beneficial office
into which he has been located by the same hand or any other hand.

assuming. They are all those in which the matter of good,
