§. Restrictions on the authority of the Legislature

Art. 1. To the authority of the Legislature no restrictions are
to be considered as being applicable to any such effect in such sort as that with any
such enactments as shall have been made by it shall be regarded as void in
law, or that either non-functionaries or functionaries other than the Executive Chief
and Justice Minister shall be regarded as warranted in disobedience
thereto.

Art. 2. But of the following exercises of authority are the attention
of the Members of the Constitutive body is hereby called to the instan in this view
namely that in case of any such exercise the several
Members of whose concurrence has been thereto given may by
a vote of the majority of such the constituents be each of them
separately displaced at any time: and in part that whether this be
done or no their conduct be held in remembrance on the occasion
of each succeeding Election.

3. Fear of the reproach of perfidy. If In so far as the acting
in the way in question towards the production of the sinister effect,
is regarded as matter of moral obligation in requital for the
sinister benefit, the whole transaction on both sides being considered
as forming the subject matter of a contract, the superadded to the
reproach of ingratitude will, on this same occasion, be the reproach
of perfidy, then ought to requite service is one general rule.
Men ought to still more punctually men ought to handicaps
when engaged for by contract, is another general rule. Unbounded
in its extent is the benefit derived from the observance of both these
general rules. Either of them would serve suffice for the destruction of society
were it not narrowed by certain exceptions. But the good
from the observance of the general rule meets the eye much oftener than
does the evil from the non-observance of the exceptions. In whatsoever
shape or degree an act is mischievous, an engagement to join in bear a part in
the commission of it does not do away the mischievousness of it.
