Constitut. Code
Here then is corruption planted – planted in the very article of the
Constitution, planted under the yoke of the by the very hand which is
striving with its utmost force to preserve the Constitution from the baleful
effects of the disease.
As to prohibition and punishment by no such instruments can
anything efficient be done towards the application of an efficient remedy
any remedy in any the smallest degree efficient be applied. The representatives
themselves by to those you may indeed prevent the good change in question from
being given. But in the case instance of any one of them can you prevent the
may be of those good things for in any number from being given to
persons connected with him in any number? Unless for himself
how is it possible for you to know who are and who are not dear
to him. The law by in with the help of by of this his Pedigree
if he has one will show who in the several degrees of concongruity
and affinity are near to him: but can any his you who
in any degree are dear to him. Can though so obvious suppose
it for argument sake and sufficiently conclusive
evidence. On the account shall it be placed in the power of a
set of Electors by electing a man to a seat and the individual elected
by accepting it to strike with a political palsy the whole of his a man's kindred
with the political palsy in question – the incapacity from holding in respect to the
office? entrance into official situations?
By what is that the dependence the consequent obsequiousness,
the consequent corrupt obsequiousness – the disposition to contribute
to the sinister sacrifice in the hope of purchasing thereby the effective favour
of the this or that giver of good gifts – by what is it created? Is it created
by any thing that can be called a contract? Is any such
communication as that which is indispensably sacrifice o the function
of a contract is any such thing necessary to the establishment of it. Supposing
for argument sake a contract to have place: in what way by
what means by this same contract is conduct influenced? Is it
not by expectation? by the expectation which is in the nature of the a
contract to produced? Well then it is not by the contract of the sinister conduct in question it is not
the contract – it is the expectation that is the immediate cause. But the
same expectation exactly as easily without as with and by a contract
is it formed: it is formed and has place to an extent beyond all calculation
greater than that to which any contracts which were if permitted and encouraged
by law instead of being prohibited could all of them added together, ever have place.
If so, how palpably absurd
and futile the
expectation supposing it capable
of being sinister
interest and – the expectation
of excluding corruption
by prohibitions and
applied to the case where a contract is among the instruments employed for the production of the corrupt operation transaction or line of conduct?
