1823. May 25
Constitut. Code

The quantity of knowledge being given supposed the same in both case, as are also the
general rectitude of judgment – the degree of appropriate intellectual
aptitude generally having place in so far as depends on judgment, the probability
of right judgment in relation to the subject in question, will
be as the intensity and duration of attention. But, be the
on an occasion such as that in question on the future occasion be it what it may, the neither in
respect of intensity nor in respect of duration can the attention
bestowed on the subject at the time at which a restriction
of this sort is imposed be so great as at the time
at which the particular subject in question is brought upon
the carpet, or would be but for the restrictive arrangement would
be. The restrictive arran Of a comparatively
and short to not long continued measure of attention
– of a survey comparatively hasty relation had to the particular
arrangement in question, has the restrictive arrangement been
in the very nature of the case: the in respect of as to the duration of
it as known and therefore limited: and thus it may
be matter of certainty that in comparison of the duration
given to the proposed arrangement which it seeks to exclude
it is inferior. Duration of the attention paid to bestowed
on the restrictive arrangement taken as a whole in its entirety, say a month twenty days
duration bestowed upon the subject of it proposed particular arrangement,
say two days. Well then upon the legislature will and pleasure of the time
at which the particular arrangement in question is or would
be brought upon the carpet it depends to bestow upon it
three days four days or as many more days as it deems
expedient. Here then is the most fully considered opinion
made to give way to the less fully considered opinion: which is
absurd.
