In each of the above cases the duration aimed at by the inhibition may be
either perpetual or temporary: in so far as it is but temporary the case where it is perpetual
and no more the system may be stiled the dilatory the mode may be stiled the perpetuity-seeking mode: in the case
where it is not perpetual that is to say is but temporary
system the mode may be stiled the dilatory mode.
As to the divisional system it is but natural
that it should be regarded as being primâ facie definitive,
that is to say intended or expected to be changed: but
still, unless by special clause powers exempted from that from change by the same authority not
intended to be the considered as unchangeable.
The Of the two remaining modes, of the immutability
declaring mode is most likely the restriction respecting
time is most apt to be applied. The meaning is
that for a certain time no such change shall be attempted,
and thence that in the work done performed by the legislative in question
no change, antecedently to the time shall be made
by any succeeding legislatures.
In the case of the second mode the intention is –
that of the field in question the portion in question shall be left altogether instructed,
instructed by the coercive hand of the legislator: by coercion
either to the effect of compulsion or restriction of the production
of positive agency, or negative.
In the two first cases the object of the restriction is to
prevent the exercise of the power in question by any hands.
In the third one case the restriction has for its object
the preventing one of each one of two or more authorities from
exercising a power which is meant to be bestowed conferred on one of them
alone, to the exclusion of the other.
