As between the several authorities in the State, as distinguished
one from another by the abovementioned names all
of them except the operation in common are the principles,
the propriety of which is here assumed, and which is accordingly
is throughout acted upon, is may be stiled the principle – that of undivided
supremacy – or unlimited dependence.

What is to The state of things what it to the production of
which its endeavours are directed is this may be thus
described. On the will of the people subject many taken collectively in so far as the nature
of things renders possible depends the exercise of what even
power to which taken severally they are subject, exactly
as in the management of the affairs of an individual
on by the will of the principal will every act of the agent, performed
in his quality of agent be in so far as he is a
faithful agent be dependent determined directed.

On this principle, the legislative is a mere customer
in the hand of the Constitutive: the Executive in both its branches a mere instrument
in the hand of the legislative, and by that means as far as possible in
the hand of the Constitutive: in both its branches, namely
the Administrative and the Judicial.

Besides and Under the Constitutive why then employ the Legislative
and again besides and under the Legislative why employ the Executive
that is to say the Administrative and the Judicial? Answer.
Only because for the performance of the business turned in to
the Executive Legislative the Constitutive can not in the nature
of the case things, have a sufficiency of time, and information
in detail respecting the matters of fact belonging to the several
cases.

So likewise because for the performance of the business
turned over to the Executive, neither can the Constitutive nor the
Legislative both together have a sufficiency of time. In regard to
each the supposition is – that it for the performance of the business
allotted to it it may
have a sufficiency of
time – but for the performance
of any part
of the business as whether
not but to a
different one of the three or the four authorities, it can not have a sufficiency of time and information.
