Constitut. Code
Exactly so is it in the case of an individual, by whom
to different other individuals in the character of servants,
agents or employees of his, different business relative to the
management of his affairs are .
For the preparation of his food meal he employs a cook or
for the care of his garden he employs a gardener, for
the care of his health he employs a physician physician.
For the performance of those several services why is it
that he has recourse to hands other than his own? Only
because for the performing of them so much in a manner so to his satisfaction
as if performed by himself, time, information, judgment or appropriate
skill moment are wanting to him.
In any one of those instances would it be for his
advantage if instead of pursuing his interest the agent
or servant his own interest to the sacrifice of that
of the principal? No assuredly. But so he might do and
sooner or later would be sure to do, if it were not in the
power of the principal to revoke the trust.
Therefore upon the scale of unpaid business as
upon the scale of individual business, power of revoking
the trust is in the reserved to the principal, reserved to him
in the case of every imaginable branch of agency the agency.
