Opposite to the same principle of undivided supremacy
in which is included the principle of omnicompetence on
the part of the legislative is the principle of the division of
power
.

The principle of undivided supremacy in the hands
of the people and under them or the hands of its several ranks of agents are under
another as to give to the maximization of the universal
felicity the utmost facility possible: namely by enabling
their principals by the agents to go on forever
making their condition making improvement
after improvement, as experience and observation the
encreasing body of experience and observation indicate
the means.

As to the principle of the division of power, it has
f its real object and its pretended object.

Its real object is It has for its real object the preserving
in the hands of a few whose interest is opposite to
that to of the people that whatsoever power power which they possess and
exercise for their own benefit and at the expence of the
happiness of the people. So long as that share of the power which
they possess and exercise remains in their hands nothing
can be done for the benefit of the people at the expence of
the power of those rulers. At the same time, for notwithstanding
the apparent division of the aggregate mass of
power notwithstanding the share which in appearance they
suffer the people to continue in possession of, everything
may by degrees be and upo of necessity sooner or later will be
done for the augmentation of their power at the expence of the
happiness of the people.

Thus it is that by the in one case in which it is marked has place
any service done by the division of power to the interest and happiness of the people.
